New Indiana Minor Reporting Requirements

Effective July 1, 2021, Indiana employers with five or more minor employees under the age of 18 are now required to register with the Indiana Department of Labor’s Youth Employment System, YES. Previously, schools were responsible for issuing work permits to minor employees. This new requirement, passed with Indiana Code 22-2-18.1-26, eliminated work permits for minors and shifts the responsibility of tracking and reporting minor employees from schools to employers.

With the YES system, employers will need to provide their work locations and minor employee details (name, age, and date of employment). Once a minor is no longer with an employer, the employer has 3 business days to remove that minor from the YES system.

Employers that need to register can set up their YES registration via: https://er.dol.in.gov/. The system can be accessed via website or a phone app.

The state’s work-hour requirements for minors remains unchanged and employers need to keep any minor work permits issued before July 1, 2021 for two years.

Employers who do not follow this new requirement are subject to penalties of up to $400 per failed report, per minor.
